MEETING FOR NEGOTIATION
TPI will hold a MEETING FOR NEGOTIATION with Trademark and Patent Attorneys in order to negotiate the professional problems in the Turkish Patent Institute on 31 January 2012. Mrs. Ayşe Ünal Ersönmez will participate in the meeting for representing Deriş Patents and Trademarks Agency.

MEETING FOR DRAFT LAW
The Turkish Patent Institute continues the legislation studies as carried out in the previous periods and has prepared the Draft Law for Amending the Decree Laws and has sent it to the Ministry of Industry and Technology for negotiations.
The said draft has been submitted for opinions of the related institutions and organizations and a workshop meeting has been held where the opinions and suggestion of particularly the academics and practitioners can be shared.
The workshop meetings will be held on 27-28 January 2012 and the schedule is being prepared by rendering a half day for each of design and trademark legislations on January 27th and by rendering a whole day for patent regulations on January 28th. Mrs. Muhlise Aydın and Mrs. Berrin Kalenderli from Deriş Patents and Trademarks Agency has participated in the meeting.

THE NEW PATENT LAW IN THE USA
As known, many significant amendments have been made in the US Patent Law in September 2011. These amendments will come into force in stages. In order to discuss the nature of these amendments, how the new provisions will affect the patent applications in the USA and the nature of the following implementations, PEM will hold a seminar on 24 January 2012 Tuesday. The seminar will be given by Gökalp BAYRAMOĞLU as the US Patent and Trademark Attorney. Mrs. Nazlı Korkut will participate in the seminar on behalf of Deriş Patents and Trademarks Agency.

Seminar on Managing Intellectual Property
Mrs. Nazlı Korkut, acting as a patent and trademark attorney for Deriş Patents and Trademarks Agency and also as the chairman of AIPPI Turkey, is going to lecture a seminar on Managing Intellectual Property for the course titled “Contemporary Topics in Business and Management” in Bilgi University, Faculty of Economics and Administrative Sciences on December 12th.

TURKEY - Change of Practice Regarding the Registrability of Servicemarks for Retail Services
The Turkish Patent Institute has revised its practice regarding the registrability of servicemarks in respect of retail services in particular with regard to the type of the concerned retail activity. The change follows the developments in the case law of WIPO Nice Classification Experts Community practice on the interpretation of services commonly referred to as “retail services”. In its decision, the Turkish Patent Institute also refers to “Praktiker” decision dated July 5, 2005 (Case C-418/02), wherein the European Court of Justice rules that the "sales" as such is not a service activity in itself as it does not relate to “bringing together, for the benefit of others, of a variety of goods, enabling customers to conveniently view and purchase those goods“ but rather relates to "bringing together variety of goods for the purpose of presenting the same to consumers”.
