The Patent Department in Deris conducts searches for products/methods for determining the novelty, State-of-the-Art or detecting any corresponding or equivalent patent/patent application. It is possible to perform an on-line search in the database of the Turkish Patent Institute or to file an official request. We also conduct “freedom-to-operate searches” within this framework.
The patent applications are published in the Official Patent Bulletin for opposition purposes by third parties. Publication watch and monitoring services are periodically provided for any subject matter through the Official Patent Bulletin, upon and in accordance with the instructions of our clients.
Deris Patents and Trademarks Agency provides assistance and advice on drafting, filing and prosecuting patent applications. We perform either nationally or through a nationalized international patent application that is filed under PCT or by the validation of European patents granted by the European Patent Office.
Since Turkey became a member of the EPC on November 1, 2000, there has been an increasing volume of validations of European patents completed by Deris before the Turkish Patent Institute (TPI)
Taking into account that the validation of European Patents augments the pages to be translated into Turkish, we have re-organized our translation department. In addition to in-house translators, we are currently working with translation offices and assermented translators who are specialized to provide translation services in certain fields such as chemistry, mechanics, etc. The work performed by the translation offices are double-checked internally both in formal and substantive terms by our staff. Considering the overall capacity of our in-house and free-lance translators and the translation offices Deris is working with, our long-standing experience and the elaborate and well established translation procedure we are able to increase our capacity which is around 50,000 pages per year. Deris is in a position to undertake any validation portfolio through special price quotation.
Deris Patents and Trademarks Agency provides strategic consulting and administrative procedure management for securing registrations in other countries. We perform so by working through our network of experienced local correspondents all over the world and directly with international authorities such as WIPO, EPO, as well as in collaboration with our allied office, Sedin S.A.
Currently, Sedin S.A. acts as the international platform of our firm and handles all IP Matters outside Turkey for the clients of our firm. According to our mutual agreement, Deris addresses to Sedin all the work received from its Turkish clients in respect of all IP matters including opposition to be filed and prosecuted in Switzerland and internationally in any other country of interest. Likewise Sedin addresses to Deris, the work received from its clients worldwide in respect of all IP matters including opposition and litigation to be filed and prosecuted in Turkey and in the Turkish Republic of Northern Cyprus (T.R.N.C.).
Deris Patents and Trademarks Agency provides services for the recordal of changes of owner and ownership against patent/patent application such as change of name, change of address, change of legal form, assignment, merger, license, etc. The recordal of such changes is not mandatory, however the rights conferred by such changes can not be invoked against third parties in good faith unless and until they are duly recorded in the Patent Register.
Deris provides assistance in complying with the patent’s working requirements. Working requirement must be satisfied within three years from the publication date of the patent’s grant/registration in the Official Patent Bulletin. To satisfy the obligation to work/use, we take the following actions before the Turkish Patent Institute:
- Recordal of importation documents
- Recordal of Certificate of Use
- Recordal of Declaration of Legal Excuse
- Recordal of the request for the publication of an offer or licensing in the Official Patent Bulletin
The working requirements must be completed only once before the Turkish Patent Institute. Not completing the requirements does not affect the validity of the patent. However the court may grant a compulsory licence upon request of third parties, if the working requirements are not satisfied.
Maintenance services, including payment of maintenance fees are handled through a fully computerized system in Deris. Maintenance fees are due on an annual basis for patent applications and patents starting from the first anniversary of the filing date
Clients receive two reminders, one for due date the other for grace period for the annuities of national, PCT and EPC applications, which must be paid on the filing anniversary date.
You can send your annuity/renewal instructions to Deris via our “ipms_e sending instruction” tool on our website www.deris.com.tr. Using this tool you can create a Renewal Instruction list for all patents due within a specified period and send instructions on-line. By doing so, you will receive a 10 % rebate on our service fees.
Deris patent attorneys prepare and file oppositions against patent applications published in the Official Patent Bulletin. We also provide services for conducting a bulletin watch for any subject matter requested by the applicant and that are deemed to be of a particular interest. We report any patent application published, for opposition purposes.
Deris patent team also reports the third party oppositions lodged against the patent applications published in the Official Patent Bulletin and assist its clients in preparing reply against the oppositions.
In addition to in-house and assermented translators, we are currently working with a team of specialized translation offices in charge of translating English, German, and French into Turkish (or vice versa) for patent specifications as well as supporting documents to be filed with the Turkish Patent Institute and the courts. Free-lance translators work under our supervision according to strictly applied procedures applied in Deris, that have been established in cooperation with our longstanding in-house translators. Translators are guided by Deris translation team to be specialized in technical areas to provide a qualified and consistent translations. Considering the overall capacity of our team, we are in a position to easily manage 50,000 pages yearly without compromising quality.
