The Law for the Acceptance of Protocol amending the TRIPS Agreement

On 6 December 2005 WTO Members approved changes to the intellectual property agreement making permanent a decision on patents and public health originally adopted in 2003 which is known as a “waiver” decision. This General Council decision means that for the first time a core WTO agreement will be amended since its inception on 1 January 1995. This will be formally built into the TRIPS Agreement when two thirds of the WTO’s members have accepted the change. The protocol amending the TRIPS Agreement has been accepted and been enforced in Turkey from 22 May 2013. By this way, it will be legally possible exports of pharmaceuticals manufactured under compulsory licenses from Turkey to countries that are unable to produce them.
